Terms and Conditions

EMC Engineering, s.r.o., with registered office at Praha 2, Blanická 25, 12000, ID No.: 25015419, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 129018 (hereinafter referred to as the “Operator”), is the operator of the ContextMinds web application accessible from the Internet address (URL) http://app.contextminds.com (hereinafter referred to as the “Application”), through which users can create, save and share concept maps under the terms and conditions set out below.

Description of the Service

The Application allows users to create graphical representations of information and knowledge in the form of concept maps. Use of the ContextMinds service (the “Service”) means any user interaction with the Application, such as viewing a concept map or moving, editing, removing or adding concepts to a map.

Concept Maps created by logged-in Users are automatically stored on data repositories under the Operator’s control. Unless a user marks a concept map as private using the relevant controls of the Application (hereinafter such concept map is referred to as a “public concept map”), the Operator will post the concept map on a publicly accessible web server for the purpose of sharing and disseminating knowledge.

The Application shall also display (suggest) to the user creating the Concept Map individual concepts from the Public Concept Maps that are semantically related to the newly created Concept Map. These hinted concepts can be added by the user to the newly created map, including any notes and other information attached to the concept and including relationships with other concepts that have already been added to the newly created map.

Rights and obligations of the parties

Anyone can use the service free of charge. However, some parts of the Service may only be available to registered (logged in) users. Some parts of the Service may be available only to registered users and for a fee.

The Operator assumes no warranty and assumes no responsibility for the non-functionality, unavailability and/or security of the Service, for the failure to save the concept map, for the leakage of information about the User of the Service, for the loss and/or corruption of data stored or created by the User, or for any other consequences resulting from the use of the Service.

The Provider reserves the right to delete data of Users who violate legal regulations and to temporarily restrict access to data suspected of violating legal regulations. The Operator may check the data in case of such suspicion, but shall not be liable for it.

By using the Service, users do not acquire any intellectual property rights in the Service or in the content created by other users that they access. Intellectual property rights in User-generated content remain the property of the User.

By uploading content through the Service without designating such content as private (see Application Help), the User grants the Operator a worldwide license to use, host, store, reproduce, modify, create derivative works from, communicate, publish, perform, publicly display and distribute such content. The rights so granted are used for the purpose of sharing knowledge among users of the Service, improving the Service and further developing the Service.

The Operator grants the User a personal, non-transferable and non-exclusive license to use the software provided as part of the Service. The exclusive purpose of this licence is to enable the use of the Service. No part of the Service or the software enabling the use of the Service may be copied, modified, distributed, sold or rented.

The Operator may modify the Service in the course of further development, for example by adding or removing features. It may also suspend or discontinue the Service altogether.

The User may also discontinue use of the Service at any time.

Personal data

The Operator collects personal identifiers of Users for the purpose of identifying content created by them. This is necessary for the functionality of the Service, so that the Application can retrieve and display the content created by the User and, conversely, prevent access to the content of other Users who have not given their permission. These personal identifiers may be created based on the user’s email address.

To log in to the Application, the User may use an account registered with a third party, such as Google or Facebook. In this case, the Service may transmit login information to these third parties for authentication purposes. The login data may also be stored in the form of so-called cookies on the user’s device - in order to speed up the login to the Application.

The Operator uses Amazon’s technical resources to store content from users, including metadata in the form of personal identifiers.

By using the Service, the User acknowledges that the Operator collects the aforementioned data for the purpose of providing the Service.

The Operator may collect certain other data for the purpose of improving the Service based on the User’s consent. Please see the Privacy Policy for details.
